New Jersey Statute N.J.S.A. 2A:35-1 gives the right to any one claiming possession of real property to have his or her rights determined by the Superior Court. This can include compelling someone on or using your land to leave the property. This is called an action for ejectment.

Ejectment cannot be used against a bona fide commercial or residential tenant. Entirely different statutes and case law controls evictions of commercial and residential tenant.

Ejectment is sometimes used to resolve boundary disputes between landowners or by successful foreclosure sale buyers to remove the former property or home owners when they refuse to leave.
